Terms of Service

Welcome to Harry McLaughlin Photography LLC (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our services, including our website located at www.harrymphoto.co (the “Site”), and any other services we provide (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

  1. Services Provided

Harry McLaughlin Photography LLC offers professional photography services, including but not limited to wedding photography, engagement sessions, corporate headshots, Portrait Noir event photo booth experiences, lifestyle branding photography, and studio rentals. The specific services provided will be outlined in a separate agreement between you and the Company.

  1. Booking and Payment

To secure your booking, a non-refundable deposit is required. The remaining balance must be paid in full according to the payment schedule outlined in your contract. We accept credit cards for all services. Studio rentals booked through Peerspace will be paid via the Peerspace portal or Venmo, following Peerspace’s policies. Headshots, Portrait Noir, and wedding photography payments are processed through the Tave portal using credit cards. Failure to make payments as scheduled may result in the cancellation of your booking and forfeiture of any payments made.

  1. Cancellation and Refunds

In the event you need to cancel your booking, please notify us as soon as possible. All cancellations must be made in writing. The deposit is non-refundable, and additional cancellation fees may apply as outlined in your contract. Corporate bookings require a minimum of 14 days’ notice for cancellations. Studio rentals follow the cancellation policies set by Peerspace. If Harry McLaughlin Photography LLC needs to cancel the services due to unforeseen circumstances, a full refund of any payments made will be issued.

  1. Client Responsibilities

You agree to provide accurate information and cooperate fully with us to ensure a successful photography session. This includes providing necessary details about the event, adhering to scheduled times, and following any instructions provided by the photographer. For studio rentals and Portrait Noir events, clients are responsible for adhering to studio rules, maintaining cleanliness, and ensuring the space is left in its original condition. Any damages may result in additional charges. Failure to comply with these responsibilities may result in additional charges or compromised quality of service.

  1. Intellectual Property

All images and content created by Harry McLaughlin Photography LLC are the intellectual property of the Company. Upon full payment, you are granted a limited license to use the images for personal, non-commercial purposes. Any reproduction, modification, or distribution of the images for commercial purposes requires written consent from Harry McLaughlin Photography LLC. For corporate branding sessions and headshots, commercial usage rights will be outlined in the specific contract. Additional licensing fees may apply for extended commercial use beyond initial agreements.

  1. Use of Images

By engaging our Services, you grant Harry McLaughlin Photography LLC the right to use the images captured during your session for promotional purposes, including but not limited to our portfolio, website, social media, and marketing materials. For corporate clients or Portrait Noir events, a written opt-out can be provided if you prefer images not be used for promotional purposes. This must be submitted before the session.

  1. Limitation of Liability

Harry McLaughlin Photography LLC will take the utmost care to provide high-quality services. However, in the unlikely event that we fail to perform due to circumstances beyond our control, our liability is limited to a refund of payments made. We are not liable for any indirect, incidental, or consequential damages arising from the use of our Services. For studio rentals and Portrait Noir events, Harry McLaughlin Photography LLC is not liable for any injuries or damages sustained during use of the space or equipment.

  1. Force Majeure

Harry McLaughlin Photography LLC shall not be liable for any failure to perform due to circumstances beyond our control, including but not limited to natural disasters, acts of terrorism, war, pandemics, supply chain disruptions, technology malfunctions, or other unforeseen events. In such cases, we will make every effort to reschedule or provide alternative arrangements.

  1. Governing Law and Arbitration

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms or the Services provided shall be resolved exclusively through binding arbitration in the State of North Carolina.

  1. Modifications to Terms

Harry McLaughlin Photography LLC reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of our Services after the posting of revised Terms constitutes your acceptance of the changes.

  1. Entire Agreement

These Terms, together with any signed contract and other legal agreements, constitute the entire agreement between you and Harry McLaughlin Photography LLC concerning our Services and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter.
